Petitioners of both the applications are accused in connection with Bhabua P.S. Case No. 319 of 2019 registered under Section 302/34 of the I.P.C. and section 27 of the Arms Act. Therefore, both applications are being heard together and
Patna High Court CR. MISC. No.65027 of 2019(4) dt.17-12-2019 2/2 disposed of by this order. Subsequently, sections 25(1-b)A, 26 and 35 of the Arms Act was added.
Submission of learned counsel for the petitioners is that petitioners are innocent and have falsely been implicated in this case. Only on the confessional statement of co-accused, petitioners have been made accused. Nothing has been recovered from the conscious possession of the petitioners. It is also submitted that petitioners have no criminal antecedent and is in custody since 11.06.2019.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Kaimur at Bhabua in connection with Bhabua P.S. Case No. 319 of 2019.
