JUSTICE ARUN KUMAR ORAL ORDER 07-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bihta P.S.Case No. 714 of 2017 registered under Sections 25(1-b)a/26 and 35 of Arms Act.

Learned counsel for the petitioner submits that one loaded country made pistol was recovered from his possession and another co-accused Vicky Kumar from whose possession also recovery was made was granted bail by a co-ordinate Bench of this Court vide order dated 01.02.2018 passed in Cr. Misc. No. 4651 of 2018.

Learned counsel for the State submits that Vicky Kumar had no criminal antecedent, but this petitioner has two criminal antecedents.

Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.7253 of 2018 (2) dt.07-02-2018 2/2 the prayer for bail of the petitioner is rejected at this stage. However, he may renew his prayer for bail after two months of framing of charge.
