2/4 the present writ petition is disposed of at the stage of admission with the consent of both the parties.

2. The only prayer sought for in the present writ petition is for disposal of the application/representation made by the petitioner seeking mutation of the subject property in his name.

Learned counsel appearing on behalf of the petitioner prays this Hon'ble Court to direct the Circle Officer, Silao, District Nalanda i.e. Respondent No. 5 herein to dispose of the said application by fixing a time frame. Learned counsel submits that the petitioner had earlier filed a writ petition being CWJC No. 24588 of 2013 and this Hon'ble Court had disposed of the same on 08.01.2016. Pursuant to which the petitioner had filed an online application dated 27.01.2016 before the Circle Officer, Silao (Annexure P/3). However, the authority till date has not disposed of the same. Thereafter, the petitioner had filed an MJC Case No. 526 of 2018 (Annexure P/9) but the same was closed on a wrong submission made by the respondentauthority. Learned counsel, therefore, seeks a direction from this Court to direct the respondent-authority to pass necessary orders on the application/representation made by the petitioner.

4. Per contra, the learned counsel appearing on behalf

3/4 of the Respondent-State has submitted that the application made by the petitioner was in the year 2016. Thereafter, the authority had issued notices to the petitioner but as the petitioner was not residing in the said address, the notices could not be served. Further, it is stated that the petitioner was informed over phone to approach the authority but the petitioner did not choose to appear, therefore, the impugned orders have been passed. Learned counsel submits that, in case, the petitioner submits a fresh application, the authority shall consider the same strictly in accordance with law and pass necessary orders.

Having regard to the same, the present writ petition is disposed of granting liberty to the petitioner to make a fresh representation/application seeking mutation of the subject property in his name along with the necessary documents within a period of four weeks from today. On such representation/application made by the petitioner, the Respondent No. 5 shall dispose of the same strictly in accordance with law as expeditiously as possible preferably within a period of 12 weeks from the date of the receipt of the copy of the representation/application by the petitioner. It is needless to observe that before passing any orders, the petitioner as well as the other private respondent i.e. Respondent Nos. 8 to

4/4 13 and any other interested party shall be put on notice and given an opportunity for filing their objections and also grant them an opportunity of hearing. Any orders passed shall be communicated to the party.

6. With the above directions, the present writ petition stands disposed of.
