JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-02-2018 The petitioners seek bail in anticipation of their arrest in connection with Raniganj P.S. Case No. 236 of 2017 dated 02.07.2017 instituted for the offences under Sections 147, 148, 341, 323, 307, 326 (A) of the Indian Penal Code. The petitioners are the cousin sister-in-law and cousin of the informant respectively. It has been alleged by the informant that because of her marrying somebody of her choice, but of a different caste, her parents and other relatives were unhappy. On the fateful day, while the mother-in-law of the informant was taking bath, all the accused persons including the petitioners variously armed with weapons, came and tried to kill her. It has specifically been alleged that one Chandan Thakur, one of the cousins of the informant assaulted her sister-in-law (Nanad)

Patna High Court Cr.Misc. No.4772 of 2018 (2) dt.05-02-2018 2/3 by means of Dabia on her head, whereas one Shyam Thakur threw acid on people who came to the rescue of the informant. The father and the own brother of the informant has also been made accused in this case.

Learned counsel for the petitioners has submitted that because of the petitioners having shown some kind of sympathy with the parents of the informant, they have been named in the F.I.R. But, fortunately, no overt act has been attributed against them and the nature of allegation is only omnibus and general. The act of assault with a sharp cutting weapon is on Chandan Thakur, whereas Shyam Thakur is alleged to have thrown acid on people who came to rescue the informant. One similarly situated co-accused viz. Shankar Thakur, another relative of the informant, has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 16.11.2017 passed in Cr. Misc. No. 55009 of 2017.

For the facts aforesaid, the petitioners, above named are directed to be released on bail, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, subject to their furnishing bail bond in the sum of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the
