The petitioner seeks bail in Jehanabad Rail P.S. Case No. 37 of 2017 registered under Sections 379 and 411 of the Indian Penal Code and Section 147 of the Railway Act. Petitioner is said to have pickpocketed Rs. 3400 of the informant in the running train and the aforesaid money was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner has been falsely implicated in this case. No incriminating article has been recovered from his conscious physical possession. Seizure list does not bear his signature. Though one more

Patna High Court Cr.Misc. No.8152 of 2018 (3) dt.19-03-2018 2/2 criminal case has been lodged against the petitioner, but he is on bail in the said case. The petitioner has been languishing in custody since 01.08.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway, Gaya in connection with Jehanabad Rail P.S.
