The petitioner is in custody since 27.09.2019 in connection with Kesariya P.S. Case No. 424 of 2019 for the offence registered under Sections 399, 402 and 120(B) of the Indian Penal Code and Section 25 (1-b) (a) , 26 (ii) and 35 of the Arms Act.

Learned counsel for the petitioner submits that admittedly, the recoveries were made from the possession of one Abhay Singh and not from the present petitioner. It is further submitted that only on the basis of the confessional statement made before the police by co-accused Alok Kumar, the name of the petitioner has been implicated in connection with the present case.

No.69982 of 2019(2) dt.19-11-2019 2/2 Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Kesariya P.S. Case No. 424 of 2019.
