The petitioner has been in custody since 31.01.2017 in connection with Nimchak Bathani P.S. Case No. 133 of 2015 for the offence registered under Sections 147, 148, 149, 109, 302 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that though the allegation against him is of assaulting the deceased, the statements which have come on the case diary corroborated the said allegation.

Learned counsel for the State after perusal of the case diary submits that there is sufficient material in the case diary to implicate the petitioner in connection with the present case. It is further submitted that it was on account of the blow inflicted by the petitioner that the deceased succumbed to his injury. The

Patna High Court Cr.Misc. No.6781 of 2018 (3) dt.20-02-2018 injury report available in the case diary supports the allegation as made out in the first information report.

Having considered the entire facts and circumstances of the case, the prayer for bail of the petitioner is rejected. However, liberty is given to the petitioner to approach this Court after framing of charge.
