2. The petitioner apprehends arrest in connection with Bettiah Nagar (Kalibagh O P) PS Case No. 490 of 2023 dated 21-06-2023, instituted under Sections 406, 420, 448, 467, 468, 471, 472,379, 384, 506 and 34 of the Indian Penal Code.
3. The prosecution case, in short, is that the petitioner along with other accused persons, by fraudulent means, got a sale deed of the land of the informant, registered in the name of co-accused, namely, Krishnakant Singh @ Tinku Singh.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. The main allegation is against co-accused, namely, Krishnakant Singh @ Tinku Singh, who is said to be the proposed purchaser of the land in-question. The said

No.83062 of 2023(2) dt.10-01-2024 2/2 Krishnakant Singh @ Tinku Singh has already been privileged with anticipatory bail by a Co-ordinate Bench of this Court vide order dated 06.12.2023, passed in Cr. Misc. No. 64909 of 2023. It is next submitted that earlier the informant had filed a case for the same dispute bearing Bettiah Town (Kalibagh O.P.) P.S. Case No. 736 of 2022 dated 12.10.2022 against the Krishnakant Singh @ Tinku Singh only. It is next highlighted that petitioner has no criminal case against him.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, West Champaran, Bettiah, in Bettiah Nagar (Kalibagh O. P.) PS Case No. 490 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
7. The application stands allowed.
