The petitioners seek regular bail in connection with G.O.Case No.201 of 2019 instituted for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 525 liters of spirit from an Indigo car bearing registration no.WB12C-6062, in which the petitioners were found sitting.

Learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case and the fact is that the driver of the said vehicle had escaped

Patna High Court CR. MISC. No.71914 of 2019(2) dt.26-11-2019 2/2 when the vehicle was intercepted by the police and search was made. It is further submitted that admittedly, the said Indigo car does not belong to the petitioners, the petitioners are having a clean antecedent and are languishing in custody since 22.09.2019.

Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on regular bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Special Judge, Excise, Nawada in connection with G.O.Case No.201 of 2019..
