2. The petitioner seeks regular bail in connection with Sabour P.S. Case No. 517 of 2022 for the offence registered under Sections 302/120(B) of the I.P.C.

3. Allegation against the petitioner is that he along with other co-accused persons have committed murder of son of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and due to village politics he has been falsely implicated in the present case. There is no cogent or direct allegation against the petitioner. He further submits that similarly situated co-accused persons namely Jitendra Kumar @ Jitendra Mandal and Suman Mandal have already been granted

Patna High Court CR. MISC. No.81851 of 2023(2) dt.05-01-2024 2/2 regular bail by a coordinate Bench of this Court vide order dated 21.08.2023 and 15.09.2023 passed in Cr. Misc. No. 44965 of 2023 and Cr. Misc. No. 47725 of 2023 respectively. The petitioner is in judicial custody since 29.11.2022. Charge-sheet has already been submitted. The petitioner has no criminal antecedent.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

6. Considering the submissions on behalf of the parties, the facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned court below in Sabour P.S.
