The petitioner has prayed for bail in connection with Rafiganj P.S. Case No. 142 of 2019 (G.R. No. 988 of 2019) registered for the offence under section 395 of the Indian Penal Code to which subsequently section 412 of the Indian Penal Code was also added.

As per the allegation in the F.I.R., six persons on two motorcycles robbed the informant of his belonging including his motorcycle, purse, ATM Card etc. It is further stated that the looted motorcycle is said to have been recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that no recovery as alleged has taken place from the house or

Patna High Court CR. MISC. No.73084 of 2019(2) dt.26-11-2019 2/2 conscious possession of the petitioner. The petitioner is in custody since 25.06.2019 and he has no criminal antecedent. It is further submitted that till date petitioner has not been put on T.I. Parade.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 142 of 2019 (G.R. No. 988 of 2019).
