====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 29-04-2025 Heard learned counsel for the petitioner and learned APP for the State. Despite valid service of notice, no one appears on behalf of O.P. No.2.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 341, 308, 379, 498A, 504 and 506/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition.

3. Petitioner, who is husband of opposite party No.2., is said to have ousted the opposite party No.2 from her

Patna High Court CR. MISC. No.83278 of 2024(3) dt.29-04-2025 2/3 matrimonial home in association of his family members over the dowry demand.

4. The allegations in the F.I.R. is with regard to demand of dowry and torture. It is admitted that the allegations leveled in the F.I.R are false and he has never indulged in any demand of dowry or torture.

5. At this stage, the petitioner offers to give Rs.2000/- (Rupees Two Thousand) per month to opposite party No.2 as well as for his child, who is allegedly living with his mother. The said amount would be paid in the account of the informant and the petitioner would make efforts to take the account number of his wife and make the said payment. Learned counsel for the petitioner further submits in paragraph 11 of his petition that he is ready to keep his wife with full dignity and honor.

In such view of the matter, let the above named petitioner, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Benipur, in connection with Ghanshyampur P.S. Case No.211 of 2023 subject to the condition laid down under Section 438
