Petitioner, already in custody, seeks bail in Bairgania PS Case No. 305 of 2017 registered under Sections 8/20(B) II/B of NDPS Act.
The allegation in brief is that 4 Kilograms of Ganja was recovered from the bag of the petitioner while he was moving with the contraband in a auto rickshaw.
Learned Counsel for the petitioner submits that neither registration number of the auto rickshaw nor name of co-passengers have been mentioned, the petitioner is student, has no criminal antecedent and is in custody since 10.11.2017. Having considered the said facts and circumstances, the petitioner, namely, Shailendra Giri is directed to be released on bail after framing of the charge on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge -cum- Special Judge Sitamarhi in connection with Bairgania PS Case No. 305 of 2017.
