JUSTICE ARUN KUMAR ORAL ORDER 03-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 24.09.2017, seeks bail in connection with Kotwali P.S.Case No. 297 of 2017 registered under Sections 302/120B/34 of the Indian penal Code and 27 of the Arms Act.

Allegation in brief is that while the informant's brother was standing in front of his shop, he was killed by motorcycle borne miscreants.

Submission is that FIR is against unknown and only material against the petitioner is the confessional statement of another accused Gautam Kumar and according to his statement he along with Munna Yadav came to the orchard of the petitioner and asked for his motorcycle and went away with that motorcycle and Munna Yadav shot at the deceased and the petitioner had no

Learned counsel for the State also concedes that only material against is the confessional statement and motorcycle of the petitioner was used by the assailants and there was no any angle of conspiracy with this petitioner.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Rana Yadav, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Munger in connection with Kotwali P.S. Case No. 297 of 2017, with condition that one of the bailor must be his close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
