Petitioner, already in custody, seeks bail in connection with Madhepur P.S. Case No.84 of 2016, giving rise to S.T. No.412 of 2017, registered under Sections 395, 392, 120(B) and 412 of the Indian Penal Code.
Allegation in brief is that some unknown miscreants committed dacoity in the house of the informant. The name of the petitioner transpired in the confessional statement of a coaccused. Learned counsel for the petitioner submits that except disclosure of name of the petitioner by a co-accused in his confessional statement, there is no other material against him,
Patna High Court Cr.Misc. No.10955 of 2018(3) dt.04-04-2018 2/2 neither any incriminating article was recovered from possession of the petitioner nor he was put on TIP, the recovery is from one Md. Ismail and the petitioner has no criminal antecedent. Having considered the said facts and circumstances, petitioner Jivachh Kumar Ray @ Jivachh Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Madhubani in connection with Madhepur P.S. Case No.84 of 2016, giving rise to S.T. No.412 of 2017.
