2. The petitioner seeks regular bail in a case registered for the offence under Sections 409, 120, 467, 468 and 471 of the Indian Penal Code.

3. The allegation against the petitioner is that he has not completed the work for the estimated amout of Rs. 4, 38,700/-.

4. Learned counsel for the petitioner submits that petitioner has completed the work for the amount of Rs. 3,32,057/-. He is ready to deposit the balance amount to the B.D.O. concerned. The petitioner is in jail since 13.09.2023.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the period of custody and the fact that the petitioner is ready to deposit the balance amount, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.F.C. Khagaria/concerned Court below in connection with Alauli P.S. Case No. 342 of 2019 subject to condition that:- 7(i)The bail bond of the petitioner shall be accepted only after the concerned B.D.O. gives the receipt of deposit of the balance amount.
