2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 96 and 3(5) of the B.N.S.

3. The case of the prosecution is that the petitioner called the minor niece of the informant, namely, Aanchal Kumari for seeing fair at Mohni Vasa near Shiv Mandir. It is further alleged that after that she has not returned and informant suspects that she has been kidnapped for purpose of marriage.

4. Learned counsel for the petitioner has submitted that during course of investigation the victim has been recovered and she has given her statement under Section 183 of the BNS wherein she has stated that she was on talking terms with the petitioner. On

Patna High Court CR. MISC. No.81199 of 2024(4) dt.11-02-2025 2/2 the date of occurence the petitioner called the victim to Mohni Vasa road and from there he took her to a temple. After that he left her there. He took her to her sisters house. When the petitioner came to know about the case, she was brought to the police station. From perusal of the statement of the victim it also transpires that no force has been used by the petitioner on her. The petitioner is having no criminal antecedent and he is in jail since 24.07.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Beldaur P.S. Case No. 260 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned court of C.J.M., Khagaria.

7. Accordingly, the present bail application stands allowed.
