JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Sarai P.S. Case No. 259 of 2018 registered for the offences punishable under Sections 414/120B of the Indian Penal Code.

As per FIR police on secret information that some stolen tractors from outside Bihar were carried raided the place an found three tractors, one Alto car and one container have been recovered and two miscreants succeeded in fleeing away and one co-accused was arrested, who disclosed the name of the petitioner and others accused persons. It further appears that papers of those vehicles were not produced at the place of occurrence.

Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him

Patna High Court CR. MISC. No.76635 of 2019(2) dt.27-11-2019 2/2 and papers of the vehicles were produced by other accused persons before the court below while considering their prayer for bail and they have been granted bail by the court below itself.

Heard learned APP also.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender and pray for regular bail, which shall be considered on the basis of above submission and, if possible, to be disposed of on the same day.
