2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Jurawanpur P.S. Case no. 05 of 2023 instituted for the offence under Sections 384 and 354 of the Indian Penal Code and Section 67 of the I.T. Act.
3. The case of the prosecution is that the daughter of the informant used to talk with the petitioner on mobile. It is further alleged that when the daughter of the informant stopped talking the petitioner, he threatened the entire family of the informant of dire consequences. It has further been alleged that the marriage of the daughter of the informant was fixed with one Prakash Kumar and when the petitioner came to know about
Patna High Court CR. MISC. No.82805 of 2024(2) dt.10-12-2024 2/3 this started demanding Rs. 10,00,000/- as 'rangdari'. It has also been alleged that the petitioner shared a fake video of the daughter of the informant to the informant and the prospective bride groom i.e. Prakash Kumar.
4. Learned counsel for the petitioner has submitted that petitioner is innocent and has falsely been implicated in connection with the present case. During the course of argument, learned counsel for the petitioner has submitted that the petitioner and the daughter of the informant were in relation out of marriage and they used to chat. The daughter of the informant was inclined to marry with this petitioner and her marriage was fixed with some other boy. The informant has apprehension that the petitioner may create some scene at the time of marriage and with that apprehension, this case has been filed. Learned counsel for the petitioner has also annexed a photo copies of the chats of the daughter of the informant and this petitioner which goes to show that they were in relation.
Learned counsel for the petitioner has further submitted that he has categorically stated in his petition that the marriage of the daughter of the informant has already been solemnized. It has also been argued by the learned counsel for the petitioner that the occurrence is of 29.12.
Patna High Court CR. MISC. No.82805 of 2024(2) dt.10-12-2024 3/3 18.01.2023. Last submission is that the petitioner is having no criminal antecedent.
5. Learned APP appearing for the State opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Jurawanpur P.S. Case no. 05 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., -III, Vaishali, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
