JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-09-2018 Heard Mr. Amarendra Narayan, learned counsel for the petitioner and learned AC to GA 1 for the respondent-State. The present writ application has been filed for quashing the order dated 31.10.2017, passed by Respondent No.3, the Assistant Inspector General of Registration, Patna in Stamp Case No. 204 of 2017, whereby the petitioner has been directed to deposit the deficit stamp, penalty as well as the interest on delayed submission of deficit stamp. After some argument, learned counsel for the petitioner seeks permission to withdraw the present writ application to file appeal before appropriate forum.

Accordingly, the present writ application is dismissed as withdrawn with above mentioned liberty to the petitioner. If such appeal is filed along with the application for condonation of delay within a period of three weeks from the date of receipt/production of a copy of this order, the appellate authority will consider the same keeping in view the fact that the petitioner was pursuing his remedy before this Court.
