2. This application has been filed for modification of the order dated 05.02.2025 passed in Cr. Misc. No.2419 of 2025 by which the petitioner was granted bail in connection with Civil Lines PS Case No.80 of 2024 to the satisfaction of the ACJM- 1st, Gaya, on certain terms and conditions.

3. Learned counsel for the petitioner submit that one of the conditions i.e., condition no.(ii) is that one of the bailors will be his own blood relation, preferably father, mother, brother, sister and or his wife and the petitioner is unable to furnish the bail bonds because all the relatives of the petitioner

Patna High Court CR. MISC. No.81742 of 2025(2) dt.28-11-2025 2/3 are landless persons and they have no source of income. Learned counsel for the petitioner prays that the aforesaid condition may be modified so that the petitioner may be released on bail in terms of the order dated 05.02.2025 passed in Cr. Misc. No.2419 of 2025.

4. Having heard counsel for the parties, it is hereby directed that the condition no.(ii) incorporated in the order dated 05.02.2025 passed in Cr. Misc. No.2419 of 2025 be treated as stands deleted. However, the mother of the petitioner shall also state on affidavit that she will inform the court concerned if the petitioner is made accused in any other case of similar nature after his release in the present case and thereafter the court below will be at liberty to initiate the proceeding for cancellation of bail on ground of misuse, and further the petitioner within two weeks from the date of his release from the jail custody shall appear before the SHO of his local area along with a copy of this order and thereafter shall appear before him in the first week of every month to mark his attendance till the disposal of the case in the Court below.

5. Rest of the conditions of the order dated 05.02.2025 passed in Cr. Misc. No.2419 of 2025 shall remain same.

Patna High Court CR. MISC. No.81742 of 2025(2) dt.28-11-2025 3/3 No.2419 of 2025 stands modified to the extent indicated above.
