====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 25-04-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the complainant.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498(A), 323, 341, 504, 506 of the Indian Penal Code and petitioner is the husband of the complainant.
3. The matter was earlier sent before the Patna High Court Mediation Center for resolution of disputes. It appears from the report of the Mediation Centre that the parties have reached an amicable settlement vide agreement dated 09.01.2025 in the Mediation Proceeding No. 1888 of 2024 and
Patna High Court CR. MISC. No.81261 of 2024(3) dt.25-04-2025 2/2 certain terms and conditions have been agreed between them. The amicable settlement made vide agreement dated 09.01.2025 shall act as full and final settlement between the parties.
3. In such view of the matter, I am inclined to extend the privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Bihar Sharif, Nalanda in connection with Complaint Case No. 1003 C of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ 482 (2) of the BNSS, 2023. However, it is expected that both the parties would strictly abide by the terms and conditions settled between them in the said agreement before the Mediation Centre, especially paragraphs 2 and 3 of the said agreement.
