The petitioner is languishing in custody since 18.07.2019 in a case registered for the offence punishable under Section 439 of the Indian Penal Code.

The prosecution case is to the effect that on 29.01.2019 at 03.015 P.M., some unknown persons entered into the financial company office of the informant and robbed off 4 Tablets (Tab), 3 mobile phones and other articles, leading to registration of FIR against unknown. Subsequently, during investigation, the name of the petitioner sprang up on the basis of confessional statement of co-accused, Mantu Kumar.

It is submitted by learned counsel for the petitioner that the petitioner has maliciously been framed in the present

Moreover, the investigation has already been concluded and a statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP for the State submits that the name of the petitioner sprang up in the confessional statement of coaccused. Considering the fact that the investigation has already been concluded, coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Vaishali at Hajipur, in connection with Goraul P.S. Case No. 25 of 2019.
