Petitioner, already in custody, seeks bail in Jhajha PS Case No. 173 of 2017, registered under Sections 25(1-b)A and 26 of the Arms Act.
The allegation in brief is that there is recovery of a country made pistol with two live cartridges Submission is that the petitioner has falsely been implicated and is in custody since 3.7.2017.
Whereas learned Counsel for the State submits that the petitioner has two criminal antecedents including one under the Arms Act.
Having considered the said facts and circumstances, the prayer for bail of the petitioner is rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of nine months. If the trial is not concluded within the aforesaid period the petitioner may renew his prayer for bail.
