2. The petitioner seeks bail in a case registered for offence under Sections 103(1), 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.

3. As per F.I.R., on 07.07.2025 at about 4 PM, coaccused Sk. Firoz shot dead brother of the informant.

4. Learned counsel for the petitioner submits that petitioner have been falsely implicated in this case. As per F.I.R. itself, Sk. Firoz shot in the chest of brother of informant, on account of which, he died. There is no allegation of any overt act against this petitioner. Petitioner has got clean antecedent and is in custody since 24.07.2025. Chargesheet has been submitted.

5. Learned A.P.P. for the State opposes the prayer for bail.

6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Katihar in connection with Amdabad P.S. Case No. 167 of 2025.
