The petitioner is accused in connection with Sessions Trial No. 387 of 2017 arising out of Azimabad P.S. Case No. 50 of 2015 registered under sections 302 and 34 of the I.P.C. and 27 of the Arms Act pending in the Court of 6th Additional District and Sessions Judge, Bhojpur at Ara.
Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in this case. He is nowhere involved in the commission of murder of the father of the informant nor was present on the spot. Further submission is that petitioner is in custody since 24.07.2017.
Patna High Court Cr.Misc. No.12175 of 2018 (3) dt.04-04-2018 2/2 Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that in paragraph nos. 36 and 37 of the case diary, there is direct allegation of firing against the petitioner and the deceased died due to firearm injuries. The witnesses have also supported the prosecution version.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. (Arvind Srivastava, J) Shailendra/- U T
