1. Heard learned counsel for the parties.

2. The instant application has been filed for modification of the order dated 12.9.2023 passed in Cr. Misc. No. 12713 of 2023 whereby anticipatory bail was granted to the petitioner in connection with Manpur P.S. Case no. 16 of 2020.

3. It is submitted by learned counsel for the petitioner that while granting anticipatory bail to the petitioner vide order dated 12.9.2023, the petitioner was directed by this Court to surrender in the learned Court below within a period of four weeks which came to an end on 10.10.2023. The petitioner could not surrender within the time fixed for reasons beyond his control as has been stated in the petition.

5. Having heard learned counsel for the parties and having perused the contents of the petition, the Court is satisfied that the petitioner has made out a case for modification of the order dated 12.9.2023 and for extension of the time therein for the petitioner to surrender.

6. Accordingly, the order dated 12.9.2023 passed in Cr. Misc. No. 12713 of 2023 is modified and it is directed that the petitioner in the event of his arrest or surrender within a period of four weeks from today in connection with Manpur P.S. Case no. 16 of 2020 shall be enlarged on anticipatory bail as granted by the aforesaid order dated 12.9.2023. Remaining part of the said order dated 12.9.2023 shall remain unchanged.

7. The modification application stands allowed to the above extent.
