The petitioner seeks bail in anticipation of his arrest in connection with Yogapatti (Nawalpur) P.S. Case No. 315/2016 dated 11.11.2016 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code. One Santosh Ram is said to have taken the mobile telephone of the informant. When the same was demanded back, a scuffle took place. The petitioner is alleged to have given a farsa blow to the brother of the informant, who had come to the rescue of the informant.

The learned counsel for the petitioner has submitted that Santosh Ram has also filed a case against the informant of the present case vide Yogapatti (Nawalpur) P.S. Case No. 316/2016

Patna High Court Cr.Misc. No.15990 of 2018 (2) dt.06-04-2018 2/2 under various sections of the Indian Penal Code and some of the sections of the SC/ST (Prevention of Atrocities) Act. The injuries suffered by the brother of the informant, as it appears from the impugned order, are not grievous.

Considering the nature of accusation and the background facts, the petitioner is directed to be released on bail, in the event of his surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. II, West Champaran, Bettiah in connection with Yogapatti (Nawalpur) P.S. Case No. 315/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
