The petitioner is accused in connection with Obra P.S. Case No. 158 of 2019, registered under Section 304(B)/34 of the Indian Penal Code.

The accusation is that marriage of Reshma Khatoon, sister of informant, Rahim Ansari, was performed before six years with Mustafa Ansari (petitioner) and due to wedlock, his sister gave birth of two male child and one female child. In spite of that his sister was being tortured by her husband (petitioner) and in-laws. On 17.06.2019, informant received information from villager of Sasural of his sister about illness of his sister, on which, he went there then saw his sister was in unconscious

Patna High Court CR. MISC. No.73533 of 2019(3) dt.16-03-2020 2/2 condition. Thereafter, his sister was rushed at Sadar hospital, Aurangabad, where she died in course of treatment on 20.06.2019.

Learned counsel for the petitioner submits that admittedly, petitioner is the husband of the deceased, sister of the informant and due to family dispute, sister of the informant consumed poison, regarding which, information was given to her Maika then informant being the brother came and his sister was rushed for treatment, where she died in course of treatment after three days. It is further submitted that petitioner is in custody since 20.06.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Obra P.S. Case No. 158 of 2019. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
