The petitioner seeks regular bail in connection with Sahebganj P.S. Case No. 270 of 2023 instituted for the offences punishable under Sections 399, 402, 413 and 414 of the Indian Penal Code and Sections 25(1-B)a/26 and 35 of the Arms Act. It is a case of alleged recovery of one loaded country made katta along with live cartridge.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that nothing has been recovered from the possession of the petitioner, petitioner has got no criminal antecedent as stated in para-3 of the petition and petitioner is in custody since

Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and period of custody of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Court No.4, Judicial Magistrate, Ist Class, (West), Muzaffarpur in connection with Sahebganj P.S.
