JUSTICE ARUN KUMAR ORAL ORDER 26-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 9.10.2017, seeks bail in Rail Darbhanga (Sitamarhi) PS Case No. 57 of 2015 registered under Sections 395 and 397 of the IPC.
The allegation in brief is that some miscreants looted the informant and his wife while traveling in a train. It is submitted that no incriminating article has been recovered from the possession of the petitioner, except disclosure of his name regarding his participation made by co-accused Anwar Alam in his confessional statement, who has already been granted bail by the court below considering the period of custody and this petitioner is also in custody since 9.10.2017. Having considered the said facts and circumstances, the petitioner, namely, Krishna Ram is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Rail Judicial Magistrate, Sitamarhi in connection with Rail Darbhanga (Sitamarhi) PS Case No. 57 of 2015.
i) One of the bailors must be a close family member of the
Patna High Court Cr.Misc. No.16561 of 2018 (2) dt.26-03-2018 petitioner; and ii) The petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
