2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

3. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Petitioner has got no criminal antecedent mentioned in Para 3 of the bail application. He further submits that the petitioner is the devar of the deceased. There is no specific overt act against the petitioner. The husband of the deceased is already in jail. He further submits that in Para 10 petitioner has solemnized marriage with one Priti Kumari, resident of villageGodda, Jharkhand against the wish of his parents. After

Patna High Court CR. MISC. No.80645 of 2023(2) dt.18-12-2023 2/2 marriage petitioner started living in Sasural with his wife and 2 years old daughter. Petitioner was working as a labour in Cuttack, Orissa.

4. Learned APP for the State has opposes the prayer for bail.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with Kahalgaon P.S. Case No. 631 of 2023, corresponding to G.R. No. 2940/2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
