Petitioner, already in custody, seeks bail in connection with Nagar P.S. Case No.211 of 2017, registered under Sections 420, 467, 468, 401, 411 and 34 of the Indian Penal Code. Allegation in brief is that the police while on night patrolling apprehended the petitioner and recovered one knife, five mobile sets and one person escaped away. It is contended that there is no independent witness in the seizure list, only police personnel are seizure list witnesses, petitioner had one mobile and recovery is shown of five mobile sets, the petitioner is in custody since 20.11.2017 and he has clean antecedent.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.18811 of 2018(2) dt.03-04-2018 2/2 circumstances, petitioner Dheeraj Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga in connection with Nagar P.S. Case No.211 of 2017.
