ANJANA MISHRA ORAL ORDER 24-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Khusurupur P.S. Case No.277 of 2019 registered for the offence punishable under Sections 467, 468, 471, 420, 120B of the Indian Penal Code and Sections 30(a), 32(1)(2)(3), 41(1) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but his name has come on the confessional statement made before the police by a co-accused. Considering the aforementioned facts and circumstances and that there is one case against the petitioner in
Patna High Court CR. MISC. No.73963 of 2019(2) dt.24-01-2020 2/2 which he is already on bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, in connection with Khusurupur P.S. Case No.277 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
