JUSTICE SANDEEP KUMAR ORAL ORDER 12-01-2024 This is the second attempt of the petitioner for grant of regular bail as earlier the bail application of the petitioner was rejected vide order dated 23.05.2023 passed in Cr. Misc. No. 26279 of 2023.

2. Heard learned counsel for the petitioner and learned APP for the State.

3. The petitioner seeks bail in connection with Manshoorchak P.S. Case No. 99 of 2022 registered for the offence under Sections 25(1-b)A, 26 of the Arms Act.

4. As per the prosecution case, one country made pistol and one cartridge has been recovered by the police from the possession of the petitioner.

5. It has been submitted by the learned counsel for

Patna High Court CR. MISC. No.83610 of 2023(2) dt.12-01-2024 2/2 the petitioner that the petitioner is innocent and has falsely been implicated in this case and he is in custody since 14.11.2022.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the facts of the case and also considering the period of custody, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail charge on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Begusarai in connection with Mansoorchak P.S. Case No. 99 of 2022.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Mansoorchak Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
