JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-06-2020 The petitioner seeks bail in connection with Bhagwanpur P. S. Case No. 68 of 2012 corresponding to Sessions Trial No. 317 of 2019 / C.I.S. No. 358 of 2019 instituted for the offences under Sections 302, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959.

It has been stated on behalf of the petitioner that he has not fired at the deceased but is only alleged to have been part of the occurrence in as much as he had fired indiscriminately outside the bus. The murder took place inside a moving bus and the act of assault has specifically been attributed to Sonu Kumar

It has also been submitted that one of the accused persons in this case has been granted bail. However, from the status report which has been received in this Court, it appears that the charges in this case have been framed on 07.08.2019 and five witnesses have been examined in this case up till now. Thus, I am not inclined to grant bail to the petitioner. However, if the trial is not concluded within a period of six months from the date of production/receipt of a copy of this order, the petitioner would have the liberty to approach this Court again for grant of bail. Dismissed with observation as above.
