Petitioner apprehends his arrest in connection with Phulwaria P.S. Case No.116 of 2017 registered for the offences under Sections 147, 148, 149, 153A, 353A, 295A, 332, 327, 337, 307 and 427 of the Indian Penal Code.
It is alleged that on the occasion of immersion procession of goddess Durga, some unknown persons including this petitioner started objectionable slogans and vulgar songs exhibiting deadly weapons.
It has been submitted that the allegation is not specific rather general and omnibus. Some of the co-accused persons, namely, Sugaki Kumar @ Prabhat Kumar @ Prabhash Kumar
Patna High Court Cr.Misc. No.14698 of 2018 (2) dt.05-04-2018 and Fucho Choudhary @ Sittu Choudhary have been granted anticipatory bail in Cr.Misc.No.9321 of 2018 on 17.02.2018 by a coordinate Bench of this Court. The case of this petitioner stands on similar footing.
The learned counsel for the informant opposed the submission.
Considering the facts and circumstances of the case, the prayer for anticipatory bail is allowed and the above named petitioner, in the event of arrest or surrender before the learned court below within six weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the likewise amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Phulwaria P.S. Case No.116 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Sanjay Kumar, J) Harish/- U
