JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Dumraon P.S. Case No. 166 of 2019 registered for the offences punishable under Sections 406,420 of the Indian Penal Code. The accusation against the petitioner is that he applied for taking amount under the scheme of Sabkae Liya Aawas Yojana and disclosed Khata No. 33, Khersa No. 237 but when the amount for construction of the house was released, he started construction on different plot which is allegedly under litigation.

Although, the present case has been registered under section 406 and 420 of the Indian Penal Code but considering the allegation levelled against the petitioner as well

Patna High Court CR. MISC. No.69907 of 2019(2) dt.27-11-2019 2/2 as facts and circumstances of the case, let petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Dumraon P.S. Case No. 166 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
