2. The petitioner seeks bail in connection with Special Case No. 74A of 2021 arising out of Mahila P.S. Case No. 55 of 2021 registered for the offence under Section 376 of the Indian Penal Code, under Section 6 of the POCSO Act and under Section 3(2)(v) of the SC/ST Act.

3. As per the prosecution case, the petitioner is the brother of the victim and he is alleged to have done some illegal act with the victim.

4. Initially, one Sunny Kumar was made accused for committing rape and during investigation, the petitioner has been made accused in this case. The victim has been examined

Patna High Court CR. MISC. No.84619 of 2023(3) dt.19-03-2024 2/2 in the trial of Sunny Kumar where she has said that the petitioner has not done any illegal act with her.

5. The petitioner is in jail since 12.4.2022.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge, POCSO, Patna in connection with Special Case No. 74A of 2021 arising out of Mahila P.S.
