JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-04-2018 The petitioners apprehend their arrest in connection with Kutumba P.S. Case No. 158 of 2017, dated 11.10.2017, instituted for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 506 and 504 of the Indian Penal Code.
The petitioners and others are said to have assaulted the informant, his brother and father, leading to
Patna High Court Cr.Misc. No.15781 of 2018 (2) dt.05-04-2018 2/2 injuries on their person. The cause of the occurrence is stated to be dispute over irrigation of field. Learned counsel for the petitioners has submitted that there is a counter version of the occurrence for which an F.I.R., vide Kutumba P.S. Case No. 159 of 2017 was instituted by the accused persons of the present case. However, considering the futility of the litigation between the parties, a decision was taken at both the ends to settle the dispute. A compromise petition also was brought into existence which has been made part of the record of this case as Annexure-3. It has further been submitted that, in fact, no injuries were suffered by the informant and others. The petitioners do not have any criminal antecedent.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Kutumba P.S. Case No. 158 of 2017.
