2. Earlier, as per order dated 06.07.2023, bail of the appellant was rejected by this Court along with a direction to the trial Court to expedite and conclude the trial as soon as possible.

3. The appellant has prayed for regular bail in this case registered for the offence punishable under sections 147, 148, 149, 324, 341, 379, 354, 307, 504 later on Section 302 of the IPC was also added and Sections 3(i)(r)(s) and 3(2)(va) of the SC/ST (POA) Act.

4. In pursuance to the direction of this Court, progress report of this case has been received on 27.01.2024, from which

Patna High Court CR. APP (SJ) No.5369 of 2023(4) dt.16-02-2024 2/2 it appears that cognizance has been taken against eight accused persons out of which one accused is languishing in judicial custody and three others appeared and summons has been issued to the rest accused persons. The trial Court has sought six months more time to conclude the trial. Learned counsel on behalf of the appellant further submitted that there is no hope to conclude the trial in the near future and the appellant is languishing in custody since 20.01.2023.

5. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the appellant on bail. The above named appellant is directed to be released on bail in connection with Buxar SC/ST P.S. Case No. 01 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-cum Special Judge Buxar.
