The petitioner seeks bail in connection with Case no. 88C2 of 2018 registered for the offence punishable under Section 30(a) of Bihar Excise and Prohibition Act-2016. 420 lts. of country made liquor is said to have been recovered from the Auto and petitioner was apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has been falsely implicated in the case merely on suspicion as he was unfortunately present at the place of occurrence at the time of occurrence. Neither he happens to be driver nor owner of the said Auto and has no concern with

Though, one more criminal case has been lodged against the petitioner, but he is on bail in the said case. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.2nd, Jamui in connection with Case no. 88C2 of 2018.
