JUSTICE VIKASH JAIN ORAL ORDER 28-05-2020 Heard learned counsel for the petitioner and learned APP for the State through video conference. Learned counsel for the petitioner undertakes to furnish proper Court Fee stamps for the Vakalatnama in order to remove defect No. 6(7) pointed out by the Stamp Reporter, immediately after the present lockdown ends, and in any event within one month thereof.

2. The petitioner is in custody since 22.08.2019 in connection with Guthani P.S. Case No. 137 of 2019 for the alleged offences under Sections 420, 467, 468, 471, 465 of the Indian Penal Code and Sections 30(a), 38(1) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

3. It is submitted that the petitioner has been falsely implicated in connection with recovery of 3287 litres and 484 ml. of foreign liquor from a truck bearing registration no. UP- 13BT-

Patna High Court CR. MISC. No.79949 of 2019(4) dt.28-05-2020 2/2 4877. The petitioner has not been apprehended from the spot rather he has been arrested from a line hotel while he was taking meal. The petitioner claims clean antecedents.

4. Learned APP appears and has been heard.

5. Be that as it may, let the petitioner above named be released on bail upon his completing one year in custody, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan in connection with Guthani P.S. Case No. 137 of 2019, if he is not otherwise required in any other case.
