The petitioners apprehend their arrest in Rajepur P.S. Case No. 81 of 2016 instituted for the offence under Sections 143, 144, 145, 147, 148, 149, 151, 152, 153A, 160, 295, 295A, 297,
Patna High Court Cr.Misc. No.16948 of 2018 (2) dt.30-03-2018 2/3 298, 395, 341, 342, 323 and 504 of the Indian Penal Code. In the written report it is alleged that 350-400 persons after forming unlawful assembly armed with weapons came at the shop of the informant and raised anti-Muslim slogans and looted away articles from the shop of the informant. Learned counsel for the petitioners has submitted that petitioners are not named in the written report. Their names have come in the supervision note of Deputy Superintendent of Police. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today, in connection with Rajepur P.S. Case No.
81 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sadar, East Champaran, Motihari, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
Patna High Court Cr.Misc. No.16948 of 2018 (2) dt.30-03-2018 3/3 reason will be liable to cancel their bail bond and (3) if petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
