The petitioner is languishing in custody since 29.03.2019 in a case registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act. It is alleged that from the possession of the petitioner, one country made loaded pistol and three live cartridges were recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been framed by the police in altogether 16 cases and the investigation has already been concluded. Learned APP for the State submits that from the possession of the petitioner, one country made loaded pistol

Patna High Court CR. MISC. No.70865 of 2019(2) dt.11-12-2019 2/2 and three live cartridges were recovered and the petitioner is having serious criminal antecedent.

Considering the nature of recovery and the investigation already being concluded, let the above named petitioner be released on bail provisionally for a period of six months, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari, East Champaran, in connection with Turkauliya Raghunathpur (O.P.) P.S. Case No. 203 of 2019. The provisional bail of the petitioner will be confirmed by the learned Court below, after observing the petitioner's conduct to the effect that he does not get substantially involved in any criminal case within the next six months. In the event of the petitioner substantially gets involved in any case, the provisional bail of the petitioner will not be confirmed and in that case, he will surrender and pray for regular bail.
