The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 75 litres of foreign liquor were recovered from the Basbari. He submits that Basbari is not belonged to the petitioner. He further submits that petitioner is involved in one another case of similar nature as stated in para-3 of the bail application and he is languishing in judicial custody since 19.09.2019.

No.72486 of 2019(2) dt.25-11-2019 2/2 In the facts and circumstances of the case, let the petitioner, above named, be released on bail, subject to deposit of Rs. 15,000/- in the court below/Nazarat, on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-IIcum-Special Judge, Excise, Samastipur in connection with Ujiyarpur Police Station Case No. 42 of 2019. Such deposit of Rs. 15,000/- shall abide by the outcome of the pending criminal case.
