Petitioner in the present case is seeking regular bail in connection with Chapra Muffasil P.S. Case No. 224 of 2019 registered for the offences punishable under Section 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the allegation and the injury sustained by the deceased is not corroborative to each other. The occurrence has taken place some where else in another manner but the informant has given the name of this petitioner. The petitioner is in custody since 21.08.2019. Learned A.P.P. for the State has opposed the prayer for

Patna High Court CR. MISC. No.70164 of 2019(2) dt.04-12-2019 2/2 bail.

Considering the facts and circumstances of the case, wherein this petitioner is main assailant and he is said to have given repeated knife blow causing instant death of the deceased, this Court is not inclined to grant the privilege of regular bail to the petitioner. The application is dismissed. Let the trial be expedited.
