The petitioner is accused in connection with Dehri (Dalmiyanagar) P.S. Case No. 908 of 2017, registered under Section 376 and 511 of the Indian Penal Code and Section 30(a), (b)(c) of the Bihar Prohibition and Excise Act, 2016. The accusation is of making attempt to commit rape upon the informant by this petitioner in drunken state on 09.11.2017 at about 2.30 P.M.

Learned counsel for the petitioner submits that, in fact, petitioner was apprehended by the Police in drunken state at the time of quarreling with his father and he was sent for medical examination by the Dalmiyanagar Police Station on 09.11.2017,

Patna High Court Cr.Misc. No.16770 of 2018(2) dt.29-03-2018 2/2 but with ulterior motive the allegation of attempt of rape has also been made. The petitioner has no criminal antecedent and he is in custody since 10.11.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-II-cum-Special Judge (Excise), Rohtas at Sasaram in connection with Dehri (Dalmiyanagar) P.S. Case No. 908 of 2017.
