The petitioners apprehend their arrest in connection with Chousa P.S. Case No. 335 of 2017 for the offence registered under Sections 147148, 149, 341, 307, 323, 354, 379, 504 and 506 of the Indian Penal Code. Learned counsel for the petitioners submits that save and except petitioner no.1, who is alleged to have attacked the informant, Dilo Singh, on the right eye, there is no other allegation against the other petitioners of having injured anybody. It is further submitted that there was dispute with regard to the land and all the accused persons had come prepared to commit any offence. It is further submitted that the injuries purported to have been inflicted by petitioner no. 1 have been found to be simple in nature.

No.16540 of 2018 (2) dt.10-04-2018 Considering the fact that there is land dispute between the parties and that there were other incidents reported with regard to the same set of offence for the similar occurrence by another co-sharer, there is no other criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Udakishanganj at Madhepura in connection with Chousa P.S. Case No. 335 of 2017, subject to the condition as laid under Section 438(2) Cr.P.C.
