JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 28-03-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner wants to renew his prayer for bail which was earlier dismissed by order dated 05.01.2016 as not pressed vide Cr. Misc. No. 40064 of 2015 and again it was rejected by order dated 21.09.2016 passed in Cr. Misc. No. 35726 of 2016, on the ground that the petitioner is suffering in custody since 01.07.2015 and the trial is not likely to be concluded in near future, the occurrence has taken place due to land dispute. The learned A.P.P. opposes prayer for bail of the petitioner by submitting that the petitioner is the assailant and the trial is in progress.

In the facts and circumstances stated above,

Patna High Court Cr.Misc. No.16666 of 2018 (2) dt.28-03-2018 2/2 finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with Sessions Trial No. 60 of 2016 arising out of Saharsa P.S. Case No. 19 of 2015 pending in the court of the 1st Additional Sessions Judge, Saharsa.

However, considering detention of the petitioner, the trial court is again directed to expedite the trial and to conclude the same preferably within six months by taking all positive steps. (Jitendra Mohan Sharma, J) Abhay/- U T
